1. Identification of Yucatán Deals
These Terms and Conditions govern access to and use of the website, the purchase of vouchers and the intermediation of experiences offered through Yucatán Deals.
Yucatán Deals is the trade name operated by Karel Willem Timmerman, RFC TIKA760920I86, with an address at Calle 48 #33, Francisco de Montejo, Quinta Etapa, Xcumpich, Mérida, Yucatán, Mexico. Customer service email: hola@yucatan.deals. Social media: @yucatandeals.
2. Nature of the service and roles of the parties
Yucatán Deals operates as a digital promotion and commercial intermediation platform. It enables independent businesses to publish experiences, consumers to purchase them electronically and consumers to receive a digital voucher for redemption.
The business identified in each offer is the final provider of the experience and the merchant of record. That business determines and must honor the price, capacity, availability, validity, restrictions, reservation policy and specific conditions of the experience.
Yucatán Deals remains responsible for its own activities, including the reasonable operation of the platform, information it creates directly, the digital purchase process, issuance and delivery of the voucher, personal data under its control and handling of complaints concerning those activities. Nothing in these Terms excludes or reduces responsibilities or consumer rights established by applicable law.
3. Participating businesses
Participating businesses are independent from Yucatán Deals. Each business represents that it has the legal capacity, RFC, permits, licences, registrations, insurance and authorisations required to provide the experience. For tourism services, the business must hold the National Tourism Registry and other sector authorisations when applicable.
The business identity, address, contact details and specific conditions must appear in the offer or voucher conditions before purchase is completed.
4. Offer information
Before payment, every offer must clearly show the total price in Mexican pesos including IVA and other mandatory charges, a description of the experience, the provider, validity, location, availability, capacity, requirements, exclusions, restrictions, reservation method, cancellation policy, no-show consequences and any deposit or additional charge.
Regular or reference prices must be genuine and verifiable prices of the participating business. Availability may be limited to the volume or period stated in the offer.
If a specific offer condition conflicts with these Terms, the provision that gives the consumer greater protection will prevail, unless mandatory law provides otherwise.
5. Purchase process
The consumer must review the description, price, quantity, contact details and specific conditions before confirming the purchase. The transaction is completed only after the consumer has been able to review and expressly accept the transaction and these Terms.
The system will send a transaction receipt and digital voucher to the email address provided. The consumer must verify the information and report errors to hola@yucatan.deals.
A purchase must be made by a person aged 18 or over or by a person with sufficient legal capacity and authority.
6. Payment, Stripe and invoicing
Payments are processed through Stripe Connect. The participating business is the merchant of record and receives payment in its connected account, subject to processing fees and the Yucatán Deals intermediation commission. Yucatán Deals does not store complete card details.
The price shown to the consumer is the total price applicable to the experience. Stripe fees, Yucatán Deals commissions and internal business costs will not be deducted from any refund owed to the consumer.
The participating business is responsible for issuing the consumer's CFDI or tax receipt for the full value of the experience. The offer or receipt must state how it can be requested or corrected. Yucatán Deals invoices the participating business for its intermediation commission under their commercial relationship.
7. Voucher, reservation and redemption
The voucher is digital evidence of the right to receive the described experience. It may contain a QR code, PIN, order number, validity period and redemption conditions.
Where a reservation is required, the consumer must make it through the stated channel and within the stated period. The reservation is subject to the availability disclosed before purchase; the business may not impose new restrictions after purchase.
A voucher cannot be redeemed for cash. Transferability, partial use, per-person limits and combination with other promotions depend solely on the specific conditions disclosed before payment.
8. Cancellations, withdrawal and refunds
Cancellations and refunds are governed by the Refund and Cancellation Policy and the specific offer conditions, without limiting mandatory consumer rights.
For distance transactions, the consumer may revoke consent during the five-business-day period provided by applicable law, without liability or justification, provided that the experience has not been used or supplied. This right does not apply when the service is scheduled for ten business days or less after the purchase order.
If the business cancels, does not provide the experience or cannot fulfil it for a reason attributable to the business, the consumer may choose an expressly accepted equivalent alternative or a full refund. Where legally applicable, the consumer is also entitled to the corresponding statutory bonus or compensation.
Outside those statutory rights, consumer-requested cancellations are decided according to the exact policy published for the offer.
9. Guarantees
Yucatán Deals does not offer a general satisfaction guarantee. If an offer expressly includes a guarantee, it must identify the responsible provider, scope, duration, conditions, enforcement mechanism and claims address. Its duration will never be shorter than the applicable statutory minimum.
10. Complaints and customer service
A consumer may complain to both the provider and Yucatán Deals. Yucatán Deals will receive and follow up on complaints concerning the purchase, payment, voucher, published information, redemption or supply of the experience and will coordinate with the business when required.
Requests are accepted at hola@yucatan.deals, Monday to Friday from 9:00 a.m. to 6:00 p.m., Mérida, Yucatán time. An acknowledgement or initial reply will be sent within two business days and Yucatán Deals will seek a resolution within fifteen business days. If additional information is required, the consumer will be told the reason and current status.
Submitting a complaint to Yucatán Deals does not restrict the consumer's right to contact PROFECO, use remedies provided by the payment issuer or pursue other legal remedies.
11. Personal data
Personal data processing is governed by the Yucatán Deals Privacy Notice. Stripe and the participating business may process the data required to process payment, fulfil the experience, issue receipts, prevent fraud and handle complaints, each under its own legal responsibilities.
Acceptance of these Terms is separate from any optional consent to advertising or to analytics technologies that require consent.
12. Legitimate use and fraud prevention
Vouchers, QR codes or PINs may not be altered, duplicated, fraudulently used or resold without authorisation. Where there are objective indications of fraud or a security risk, Yucatán Deals may temporarily suspend redemption while investigating. It must inform the consumer, permit clarification and correct any erroneous block.
Permanent invalidation may only occur where sufficient evidence shows fraud, duplication, a completed chargeback or use contrary to accepted conditions. If suspension or invalidation was erroneous, the voucher will be restored or the appropriate refund will be made.
13. Platform availability
Yucatán Deals seeks to keep the platform available and secure but may perform maintenance or experience interruptions. Where a platform failure attributable to Yucatán Deals prevents a purchase, delivery or redemption, Yucatán Deals must correct the issue, restore the voucher or coordinate a refund as appropriate.
14. Intellectual property
Yucatán Deals content, trademarks and materials are protected by applicable law. Participating business trademarks, photographs and materials belong to their respective owners and are used with permission. Purchasing a voucher does not grant reproduction or commercial exploitation rights.
15. Responsibility
The participating business is responsible for the quality, safety, legality and delivery of its experience. Yucatán Deals is responsible for its own acts and omissions as platform and intermediary. No provision excludes civil responsibility, improperly shifts it to the consumer or a third party, or requires the consumer to waive non-waivable rights.
Where a failure involves both parties, each will be responsible according to its involvement and applicable law or the decision of the competent authority.
16. Amendments
Yucatán Deals may amend these Terms for future transactions. The version accepted and stored at the time of purchase continues to govern that transaction. Amendments will not retroactively reduce rights or change existing purchases.
17. Law, language and disputes
These Terms are governed by the laws of the United Mexican States. The Federal Consumer Protection Agency, PROFECO, has administrative authority within its statutory powers. The consumer retains every jurisdiction or forum made available by mandatory consumer protection rules.
The Spanish version is the principal text. The English version is provided to aid understanding. In case of discrepancy, the Spanish version applies, without prejudice to any interpretation most favourable to the consumer required by law.
18. Acceptance
Before payment, the consumer must select an unticked checkbox stating that the consumer has read and accepts these Terms and the specific offer conditions. The system will retain evidence of the accepted version, date, time and transaction.
